UCN Bookstore Terms of Use and Privacy Policy 

 

This UCN Bookstore Terms of Use and Privacy Policy applies to your use of the University College of the North Bookstore website: bookstore.ucn.ca (the "Site"). University College of the North (UCN) is subject to The Freedom of Information and Protection of Privacy Act (Manitoba) and this UCN Bookstore Terms of Use and Privacy Policy is in addition to and not in lieu of the UCN Privacy Policy. TERMS OF USE

  1. Agreement. By accessing, browsing or using the Site, you accept and agree to these UCN Bookstore Terms of Use and Privacy Policy. You acknowledge that UCN may amend these terms and conditions at any time and without notice. It is your responsibility to review the UCN Bookstore Terms of Use and Privacy Policy each time you visit the Site.

  2. Ownership. All trademarks, designs, graphics, materials, sounds, and content appearing on the Site are proprietary to UCN and its licensors or the party accredited as owner. These works are protected by trademark rights, copyright and intellectual property rights at law. You may make no use of same without the prior written consent of UCN.

  3. Acceptable Use. You agree to only use the Site for its intended purposes of an ecommerce bookstore. You shall not, without our prior written permission, use the Site for purposes other than your own personal and non-commercial use. You may not, in connection with your use of the Site: (i) engage in distributing computer viruses, worms, Trojan horses, or other malicious code, (ii) infringe the intellectual property rights or other proprietary rights of third parties, (iii) attempt to overwhelm the Site, or (iv) engage in any illegal activities of any kind.

  4. Return Policy.

         (a) Goods returned for refund or exchange must be in new, unmarked, resalable condition and must be accompanied by the original sales receipt.  All                 returns must comply with the guidelines as set forth within this policy.

         (b) The following items are ineligible for return: Barcharts, course packs, NAIT modules, earphones/earbuds, locks, course equipment, gift cards,                          items removed from their original packaging, special orders, used access codes, clearance items, food.

          (c) A refund is not available on purchases of $1.00 or less. 

          (d) If an item is defective, an exchange will be granted.    

          (e) Textbooks in shrink wrap plastic wrappers cannot be returned once the seal is broken.

          (f) The time limit for return is 14 days from the date of purchase for students on campus. Textbook returns from offsite Regional locations must be                       returned within the same term requested. General merchandise returns are 14 days from date of purchase. No returns will be done for book(s)                       purchased within two (2) weeks prior to the exam for which the book is required.

          (g) Textbooks that are beyond the above mentioned fourteen (14) days, may still be considered for return if the original receipt is present, the textbook                  is in resalable condition, it is within 31 days of purchase, and is accompanied by an add/drop or withdrawal form. 

          (h) The refund process for purchases made by cash or cheque will be determined on a case by case basis.  Depending on the amount of the refund,                    they will either be refunded through the POS at the time of request or through Finance by method of an Accounting refund which is done weekly                    by Accounts Payable.  Refunds for purchases made by cheque are subject to a ten (10) day waiting period. Refund cheques are mailed to the                        recipient. A copy of the original receipt must accompany all refunds.

         (i) Returns on purchases made with debit or credit card must be accompanied with the original sales receipt, and refunds will be credited back in the                  same method as originally charged when the purchase was generated.

         (j) Returned textbooks and supplies purchased on sponsorship are returned back onto the sponsorship, no cash value is returned to the student.

         (k) Digital products (e-texts and access codes) are subject to publisher approval before a return may be granted.  If a publisher declines a return, no                    refund can be granted.

         (l) Defective products may be exchanged within the applicable return period if accompanied with the original sales receipt and approved by Bookstore               personnel. Manufacturer warranty may apply to calculators. 

         (m) Items ordered online must be first approved for return by emailing bookstore@ucn.ca.  Once approved, the return shipping & related charges are                   the responsibility of the customer. 

         (n) Resalable condition will be determined by the Bookstore staff in their discretion.

  • Textbooks & course materials – no writing, highlighting, scratched covers, bent or dog-eared corners. Textbooks or course materials that are shrink-wrapped are not returnable once wrapping is removed or broken

  • Clothing – unworn, tags intact, free from pet hair or other debris

  • Supplies & Promo items – Undamaged, packaging and tags intact

         (o) UCN Bookstore will make every effort to return overstocked textbooks that qualify for return privileges.

         (p) In the event that non-returnable textbooks and/or printed materials are adopted for programs, UCN Bookstore personnel will advise the requestor                  of the non-returnable status on the selected material and will require appropriate approval before proceeding with the order. Any unsold stock will                    be charged to the program responsible for ordering.  The stock then becomes the property of the program charged. If any of this stock is requested                for the program within the next program year, the UCN Bookstore may credit the department and bring the stock back into inventory for resale but                  only if the stock is in resalable condition.

          (q) Bachelor of Arts non-returnable texts billed out to the program will be held for a period of two years before becoming the property of the UCN                         Library.

          (r) UCN Bookstore reserves the right to refuse refunds or exchanges that do not meet their standard for return.  

5. Disclaimer. Your use of the Site is at your sole risk. The Site is provided on an as is basis and without warranties, express or implied, of any kind, including without limitation warranties as to title, non-infringement or fitness for a particular purpose and UCN does not warrant that the Site will be uninterrupted or error-free. While UCN takes reasonable steps to keep the Site secure, we do not warrant that the Site is free of unknown viruses or harmful materials.

6. Limitation of Liability. UCN is not liable to you or any person for any damages, harm, or injury caused whatsoever through your use of the Site or your inability to use the Site.

7. Links and Third Party Sites. The Site may contain links to third party sites. These links do not constitute an endorsement of such third party sites. UCN is not responsible for the content of third party sites and you are strongly recommended to review third party website terms and conditions.

8. Termination. UCN reserves the right to terminate this Site or any services offered through the Site at any time.

9. Governing Law. These UCN Bookstore Terms of Use and Privacy Policy are governed by the laws of the Province of Manitoba and Canada and the parties irrevocably attorn to the jurisdiction of the courts of Manitoba with respect to any dispute.

PRIVACY POLICY

10. UCN will collect your personal information to facilitate your use of the Site and to record any purchase you make. Your personal information obtained through your use of the Site will only be used for this purpose and in accordance with applicable law.

11. Payments are processed through a third party service provider and when you purchase on an ecommerce basis through the UCN Bookstore, you will be redirected to a third party website for payment processing which may be outside of Canada. Use of the third party' payment processing service will be subject to such third party's terms and conditions. You should carefully review such terms and conditions prior to proceeding.

12. UCN does not record or retain your financial information submitted through the Site for ecommerce purposes.

13. UCN does not disclose personal information to third parties except where required or permitted by law.

14. UCN Site may uses cookies to improve our Site and services provided to you. A cookie is a small file that is placed through our Site on to your computer, and the cookies allows us to recognize your use and customize your experience. Some cookies we use are analytics cookies which allow us see how visitors move around our Site. We also use cookies to improve the way our Site works by ensuring that users find what they are looking for more easily. Your use of third party sites and services may involve third party cookies.

You can block cookies by activating the setting on your browser that allows you to refuse the placing of cookies on your computer. If you use browser settings to block all cookies, you may not be able to use all or part of the Site.
